1. Acceptance of Terms

By accessing and using the website ltdkanser.xyz and any services provided by LDTKanser Ltd. ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and LDTKanser Ltd. We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

2. Description of Services

LDTKanser Ltd. provides the following services:

• Mobile application development for iOS and Android platforms
• Mobile analytics integration and optimization
• User acquisition (UA) and performance marketing campaigns
• App Store Optimization (ASO) and creative production
• Consulting on mobile product strategy and growth

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. Eligibility

Our services are intended for businesses and individuals who are at least 18 years of age and have the legal capacity to enter into binding agreements. By using our services, you represent and warrant that you meet these requirements.

4. Client Responsibilities

When using our services, you agree to:

• Provide accurate, current, and complete information as requested
• Maintain the confidentiality of your account credentials
• Use our services only for lawful purposes and in compliance with all applicable laws
• Not use our services to promote fraudulent, misleading, or harmful content
• Not attempt to reverse-engineer, decompile, or exploit any part of our services
• Not interfere with or disrupt the integrity or performance of our systems
• Promptly notify us of any unauthorized use of your account

5. Intellectual Property

All content, code, designs, logos, trademarks, and other intellectual property ("IP") associated with LDTKanser Ltd. and our services are owned by or licensed to us and are protected by applicable intellectual property laws.

• You may not copy, reproduce, distribute, modify, or create derivative works of our IP without prior written consent
• Our logos, brand names, and visual identity may not be used without authorization
• Any feedback or suggestions you provide may be used by us without obligation to you

For client projects, ownership of deliverables is governed by the specific service agreement. Unless otherwise agreed in writing, all pre-existing IP and tools used in development remain the property of LDTKanser Ltd.

6. Payment Terms

• All fees are as specified in the applicable service agreement or subscription plan
• Payments are due according to the schedule agreed upon in your contract
• Late payments may incur a fee of 1.5% per month on the outstanding balance
• All fees are non-refundable unless otherwise specified in the service agreement
• We reserve the right to suspend services for overdue accounts after 14 days' written notice

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the business relationship. This includes but is not limited to: business strategies, financial data, user data, technical specifications, and trade secrets. Confidentiality obligations survive termination of these Terms for a period of three (3) years.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• LDTKanser Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total aggregate liability shall not exceed the total fees paid by you to us during the twelve (12) months preceding the claim
• We are not liable for damages resulting from third-party services, including but not limited to advertising platforms, analytics providers, or hosting services
• We do not guarantee specific results, performance metrics, or return on investment from our services

9. Indemnification

You agree to indemnify, defend, and hold harmless LDTKanser Ltd., its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of our services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content or data you provide or transmit through our services

10. Termination

Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. We may suspend or terminate your access to our services immediately if:

• You breach these Terms or any applicable service agreement
• Your payment is overdue by more than 14 days
• We are required to do so by law or regulatory authority

Upon termination, all outstanding fees become immediately due. Provisions that by their nature should survive termination will survive, including Sections 5, 7, 8, 9, and 11.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

If you are located outside the United Kingdom, you are responsible for compliance with local laws to the extent they apply.

12. Dispute Resolution

Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue mediation or binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. The latest version will always be available on this page with the updated effective date.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with any applicable service agreements and our Privacy Policy, constitute the entire agreement between you and LDTKanser Ltd. regarding the use of our services, superseding any prior agreements or understandings.
